BYD files US lawsuit to recover tariffs
The world's largest electric vehicle manufacturer, BYD, has filed a lawsuit in the U.S. Court of International Trade, demanding the return of paid tariffs imposed under President Trump. According to Bloomberg and court documents, BYD's American subsidiaries consider the executive orders that introduced the tariffs invalid and their collection unlawful. Over a thousand companies, including Costco and Goodyear, are already challenging the tariff thresholds in the court system. The U.S. Supreme Court has not yet issued a final ruling on the legality of these tariffs.
Context
In 2019, President Trump's administration imposed tariffs on Chinese car imports as part of aggressive trade measures. Since then, many companies, including BYD, have been litigating their legality.
BYD sought the cancellation of import duties introduced in 2019, claiming they violate the law. Thousands of companies are already involved in the legal proceedings.
